Terms and Conditions

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND

IN CONSIDERATION of being permitted to participate as a member in any of the events, activities, and benefits provided by virtue of membership with the WALNUT GOLF CLUB, LLC, you hereby:

Acknowledge, recognize, and understand that there are risks associated with your participation in the events, activities, and benefits of membership including, but not limited to, bodily injury or death to persons and theft, damage or destruction to property. You further acknowledge and understand that you will be held liable and responsible for any and all damage to persons, vehicles, property, and/or improvements to property that you cause or is otherwise caused by persons under your care and control, and that arise out of or are related to your participation in the events, activities, and benefits.
Release, acquit, and forever discharge WALNUT GOLF CLUB, LLC, its subsidiaries and affiliates, present and former directors, officers, employees, agents, volunteers, and representatives and the respective heirs, administrators, executors, and assigns from any and all claims, demands, causes of action, suits, judgments, settlements, expenses for personal injury, death and/or property damage, accrued or to accrue in the future, known or unknown, relating to or arising out of any negligent acts in connection with your entry into and participation in events, activities, and benefits provided by virtue of membership with the WALNUT GOLF CLUB, LLC, including but not limited to negligent actions of the Walnut Golf Club, LLC Parties, regardless of whether such negligence was the sole, proximate or producing cause of the claims. Without limiting the foregoing, you agree that the Walnut Golf Club, LLC Parties shall not be liable to you, your family, heirs, administrators, executors or assigns for claims arising from or related to your entry into and participation in events, activities, and benefits provided by virtue of membership with the WALNUT GOLF CLUB, LLC.
Agree to defend, indemnify and hold harmless the Walnut Gold Club, LLC Parties from any and all claims, demands, causes of action, suits, judgments, settlements, expenses for personal injury, death and/or property damage, accrued or to accrue in the future, known or unknown, including but not limited to claims resulting from the Walnut Golf Club, LLC Parties’ own negligence, regardless of whether such negligence was the sole, proximate or producing cause of the claims; provided however, that the duty to defend, indemnify and hold harmless shall extend only to claims arising directly or indirectly from your entry into and participation in events, activities, and benefits provided by virtue of membership with the WALNUT GOLF CLUB, LLC.

MEMBERSHIP CODE OF CONDUCT

Members of the WALNUT GOLF CLUB, LLC hereby agree to conduct themselves at all times appropriately, to refrain from any and all actions that are reckless or negligent or otherwise could lead to physical harm and/or death of other members or employees, or to property damage and damage to the facilities. Members further agree to dress appropriately, to wear appropriate footwear, to avoid sexual misconduct of any kind, to avoid foul or abusive language regardless of whether or not it is directed at other members or to employees, to abide by all instructions and directions given by employees, and to otherwise refrain from any and all illicit and illegal activities while on WALNUT GOLF CLUB, LLC property or using its facilities. Members will refrain from photographing, video recording, or audio recording other members or employees without permission. Violations and repeated infractions of this Membership Code of Conduct may result in complete revocation of membership.
